RūfPlus Terms and Conditions

1. Definitions:

  • “RūfPlus” refers to RūfPlus LLC, a roofing contractor operating in the Kansas City Metropolitan Area.
  • “Homeowner” or “Client” refers to the individual(s) contracting RūfPlus for roofing services at the property address specified in the project quote.
  • “Project” refers to the roofing repair, replacement, or installation work described in the project quote.
  • “Scope of Work” refers to the detailed description of the roofing work to be performed, including materials, labor, and specifications.
  • “Change Order” refers to a written agreement modifying the Scope of Work, including any changes in materials, labor, or schedule.
  • “Substantial Completion” refers to the point at which the roofing project is sufficiently complete for its intended use, as determined by RūfPlus.
  • “Manufacturer’s Warranty” refers to the warranty provided by the material manufacturer, not RūfPlus.

2. Scope of Work:

  • The Scope of Work is outlined in the project quote. Any discrepancies between the quote and actual site conditions will be addressed through a Change Order.
  • RūfPlus reserves the right to make minor adjustments to the Scope of Work as necessary to ensure proper roofing installation and compliance with building codes.

3. Unforeseen Conditions:

  • RūfPlus is not responsible for conditions discovered after work commences that were not reasonably detectable during the initial inspection, including but not limited to:
    • Rotten or damaged decking
    • Hidden structural damage
    • Presence of asbestos or other hazardous materials
    • Undiscovered code violations
  • Addressing unforeseen conditions will require a Change Order and may result in additional costs.

4. Change Orders:

  • All changes to the Scope of Work must be documented in a written Change Order, signed by both parties, detailing the changes, associated costs, and schedule adjustments.
  • Work will not commence on any Change Order until it is signed by both parties.
  • RūfPlus is not responsible for delays caused by unsigned Change Orders.

5. Payment Schedule:

  • A 50% deposit is required upon signing the project quote.
  • Progress payments will be invoiced at predetermined stages of completion, as specified in the quote or Change Orders.
  • The final payment is due within 10 days of Substantial Completion and final walkthrough.
  • If insurance is involved, the homeowner is responsible for providing proof of claim submission within 7 days of the final walk-through, and the remaining balance is due upon insurance payment, or 30 days from the final walk-through, whichever comes first.
  • RūfPlus reserves the right to place a mechanic’s lien on the property for unpaid balances.

6. Warranty:

  • RūfPlus provides a Lifetime Workmanship Warranty, covering defects in labor for the duration that the homeowner owns the home.
  • This warranty does not cover:
    • Damage caused by natural disasters (wind, hail, earthquakes)
    • Damage caused by improper maintenance or neglect
    • Damage caused by third-party modifications
    • Material defects, which are covered by the Manufacturer’s Warranty.
  • Any work performed by other contractors on the roof will void RūfPlus’s Lifetime Workmanship Warranty.
  • RūfPlus is not liable for consequential damages.

7. Insurance Proceeds and Contract Price:

  • RūfPlus will assist the homeowner in communicating with their insurance company, but the homeowner is ultimately responsible for managing their claim.
  • RūfPlus is entitled to receive any supplements approved by the homeowner’s insurance company.
  • The homeowner is responsible for paying any deductibles or non-covered items.
  • The homeowner authorizes RūfPlus to communicate and negotiate directly with their insurance carrier regarding the scope and cost of repairs.
  • The scope of work for this project shall be the final scope approved by the insurance carrier. The total contract price shall be the final Replacement Cost Value (RCV) determined by the insurance carrier for the approved scope of work.
  • The owner’s sole financial responsibility for the approved scope is their policy deductible and the cost of any upgrades or additional work they have approved in writing.
  • The homeowner agrees to promptly endorse any checks from the insurance carrier related to this claim and remit all insurance proceeds to RūfPlus.

8. Late Payments:

  • Unpaid balances will accrue interest at a rate of 1.5% per month.
  • The homeowner is responsible for all collection costs, including reasonable attorney’s fees.

9. Card Fees:

  • A 3% processing fee will be added to payments made with credit or debit cards.
  • ACH payments are exempt from processing fees.

10. Dispute Resolution:

  • Any disputes arising from this agreement will be resolved through mediation in Olathe, Kansas.
  • The prevailing party in any dispute will be entitled to recover reasonable attorney’s fees and costs.

11. Permits and Compliance:

  • RūfPlus is responsible for obtaining all necessary permits and ensuring compliance with local building codes.
  • RūfPlus will provide the necessary documentation for permit applications.

12. Material Delays:

  • RūfPlus is not responsible for delays caused by material shortages, supplier delays, or other factors beyond its control.

13. Access and Utilities:

  • The homeowner will provide RūfPlus with reasonable access to the property and ensure that necessary utilities (power, water, etc.) are available.

14. Site Conditions and Debris:

  • RūfPlus will make reasonable efforts to protect the property during the project but is not responsible for preexisting conditions or damage caused by normal construction activities.
  • RūfPlus will remove construction debris from the site, but the homeowner is responsible for disposing of any personal items.

15. Termination:

  • Either party may terminate this agreement with written notice if the other party materially breaches its terms.
  • In the event of termination by the homeowner, the homeowner will be responsible for payment for all work completed up to the termination date, including materials purchased.

16. Limitation of Liability:

  • RūfPlus’s liability under this agreement is limited to the total contract price.

17. Governing Law:

  • This agreement will be governed by the laws of the state where the property is located (Kansas or Missouri).

18. Severability:

  • If any provision of this agreement is deemed invalid, the remaining provisions will remain in effect.

19. Entire Agreement:

  • This agreement constitutes the entire understanding between the parties and supersedes any prior agreements.  

20. Acknowledgment:

  • By signing the project quote, the homeowner acknowledges that they have read, understood, and agreed to these Terms and Conditions.
